Associação Brasileira do Segmento de Reforma de Pneus em nota à imprensa

A Associação Brasileira do Segmento de Reforma de Pneus (ABR) compreende que a interpretação do Itamaraty, divulgada dia 12 de junho (terça-feira), em nota oficial, não corresponde às conclusões e recomendações do relatório final do Painel da Organização Mundial do Comércio.

Ao contrário da interpretação do Ministério das Relações Exteriores, o documento oficial da OMC afirma que a legislação brasileira não está em conformidade com o GATT 1994.

A nota do Itamaraty busca, nitidamente, constranger o Poder Judiciário colocando em questão a independência e a soberania do mesmo.

Para a ABR, o que está em disputa é a sobrevivência da indústria nacional de pneus reformados com o cerceamento do direito de acesso a sua matéria-prima fundamental. Ou seja, a questão é puramente comercial, já que envolve grupos econômicos de interesses muito fortes.

A ABR reitera que o argumento ambiental não encontra amparo na realidade dos fatos, já que o Brasil possui uma das legislações ambientais mais modernas do mundo em relação à destinação final dos pneus inservíveis (Resolução Conama 258). Em nenhum momento do contencioso foi apresentada documentação técnica por parte dos órgãos do setor ambiental que comprovasse que a indústria de remoldados provoca prejuízo à natureza e à saúde pública.

Com o objetivo de esclarecer os diversos setores da sociedade envolvidos, a ABR está consultando especialistas em comércio exterior e relações internacionais para apresentar um relatório técnico sobre o assunto.

A seguir capítulo das conclusões e recomendações do relatório final do Painel da OMC, conforme o texto original: Conclusions and recommendations - 8.1 In light of the above, the Panel concludes that: (a) with respect to Brazil's import prohibition on retreaded tyres: (i) Portaria SECEX 14/2004 is inconsistent with Article XI:1 of GATT 1994 in that it prohibits the issuance of import licences for retreaded tyres, and is not justified under Article XX(b) of GATT 1994.

(ii)Portaria DECEX 8/1991, to the extent that it prohibits the importation of retreaded tyres, is inconsistent with Article XI:1 and is not justified underArticle XX(b) of GATT 1994.

(iii)Resolution Conama 23/1996 is not inconsistent with Article XI:1. (b) with respect to the fines imposed by Brazil on importation, marketing, transportation, storage, keeping or warehousing of retreaded tyres, Presidential Decree 3.179, as amended by Presidential Decree 3.919, is inconsistent with Article XI:1 of GATT 1994 in that it imposes limiting conditions in relation to the importation of retreaded tyres and is not justified under either Article XX(b) or Article XX(d) of GATT 1994.

(c) with respect to the measures maintained by the Brazilian State of Rio Grande do Sul in respect of retreaded tyres, Law 12.114, as amended by Law 12.381, is inconsistent with Article III:4 of GATT 1994 in that it accords less favourable treatment to imported retreaded tyres than to like domestic products and is not justified under Article XX(b) of GATT 1994.

8.2 With respect to the European Communities' claims that Brazil's Mercosur exemptions are inconsistent with Articles XIII:1 and I:1 of GATT 1994, the Panel has decided to exercise judicial economy.

8.3 Under Article 3.8 of the DSU, in cases where there is an infringement of the obligations assumed under a covered agreement, the action is considered prima facie to constitute a case of nullification or impairment. The Panel concludes that, to the extent that the measures listed above are inconsistent with GATT 1994, they have nullified or impaired benefits accruing to the European Communities under that agreement.

8.4 Accordingly, the Panel recommends that the Dispute Settlement Body request Brazil to bring these inconsistent measures as listed above into conformity with its obligations under the GATT 1994
